Terms of Service

This Terms of Service Agreement ("Agreement") is entered into by and between Find Your Doula ("FYD," "we," "us," or "our") and you, the user ("User" or "you"), governing your use of FYD’s website and services.

1. Description of Services

Find Your Doula provides the following services:

Paid Service for Mothers: Clients fill out a form with pregnancy and birth details, desired doula preferences, estimated due date, location, and other relevant information. FYD identifies suitable doulas available during the estimated due date and provides a selection for the client to contact and potentially hire.
Free Service for Mothers: Clients provide the same information as above, and FYD lists it in a leads section accessible to doulas. Doulas may reach out to clients if interested.
Service for Doulas: Doulas access a leads section containing information about mothers seeking doula services. Doulas interested in connecting with a mother provide their corresponding number to FYD and pay for access to the mother's contact information.

FYD does not endorse or affiliate with doulas or their services; it solely facilitates connections between mothers and doulas.

2. Forum Usage

Users of FYD’s community forums ("Forum Users") are expected to engage in respectful and lighthearted discussions related to doulas and related topics. Harassment, bullying, or posting of inappropriate content is strictly prohibited. FYD reserves the right to moderate content and suspend or terminate accounts of Forum Users who violate these guidelines.

3. User Responsibility

It is the responsibility of both mothers and doulas to verify the legitimacy of each other. FYD is not liable for any transactions or agreements made between mothers and doulas. Mothers are responsible for selecting a doula they are satisfied with once provided with a selection.

4. Account Terms

There are no mandatory requirements for creating an account, but users must accurately represent themselves as either pregnant mothers seeking a doula or certified doulas seeking clients. Any information provided is voluntary and used solely for the terms outlined in this Agreement.

5. Payment and Refund Policy

Mothers: Payment is collected after filling out the free form and confirming their desire for FYD to find them a selection of doulas. A refund is available if FYD fails to provide a suitable selection within a reasonable timeframe.
Doulas: Payment is collected upon emailing FYD with the corresponding number for a lead they wish to obtain contact information for. Refunds for doulas are at FYD’s discretion on a case-by-case basis.

6. Privacy Policy

User data is collected and used as described in our Terms of Service agreement. Data is not shared with third parties without permission, and is shared only among FYD, prospective doulas, and mothers seeking doulas.

7. Intellectual Property

All content on the FYD site is owned by FYD. Users may share basic information but may not claim it as their own or reproduce it without crediting FYD. Lead content may only be used within the FYD platform and not shared elsewhere.

8. Dispute Resolution

Any disputes arising from or related to this Agreement shall be resolved through mediation with FYD or arbitration in [Your City, State/Country] in accordance with the rules of the American Arbitration Association.

9. Limitation of Liability

FYD shall not be liable for any issues arising from the use of its services. Users use the platform at their own discretion.

10. Modification to the ToS

FYD reserves the right to modify these Terms of Service at any time. Users are responsible for regularly reviewing the terms. Continued use of the services after changes constitutes acceptance of the modified terms.

11. Termination

FYD reserves the right to terminate accounts for any reason, including breach of this Agreement or the Privacy Policy.

By using FYD’s services, you acknowledge that you have read, understood, and agree to be bound by this Terms of Service Agreement.
